Mediator vs Moderator


Often in the course of legal matters, mediation is a required step. Mediation is also used as a method to limit financial costs of an action as mediation can be just as effective as a trial, and tends to have a better outcome for both parties as there is more input from the disputants regarding the settlement. But how do you know if you require a mediator vs moderator?

Mediator vs Moderator

Moderators, while often used as a synonym for mediators, have very specific, and often limited, roles that are similar in a few ways to the roles of mediators. The title of moderator often refers to the chairperson of a meeting, or a member of a panel overseeing a debate or forum. There are also religious and political positions that carry the title of moderator, typically in a town council setting.

These days, the title of moderator is most often associated with technology and Internet positions, such as forum or game moderators. In those cases, the moderator is a person, or group of people, responsible for upholding the rules of the forum or game, and dispensing an adequate punishment if necessary. The moderator of a debate would be much the same, in that they are responsible for the adherence to the rules, and to decide the victor of the debate. In capacities such as these, moderators are similar to mediators in their duties.

Mediators are trained professionals who act as an intermediary in a dispute. The services of mediators are typically sought in legal cases as a step to avoid litigation. For example, in many situations, mediation is a required step in divorce proceedings. Mediators can be invaluable in other family disputes, such as the dissolution of a family business, which parties wish to keep out of the courts.

Role of a Mediator

The role of a mediator is to listen to both sides of the dispute, and any other parties that may be involved, and to help the parties come to a fair and equitable settlement. Mediation does not always achieve the end goal; sometimes both parties are too stubborn in their positions to come to a fair settlement. In those cases, the dispute will then go to litigation.

Through education and training mediators are able to specialize in a number of areas, and some areas have sub-specializations as well. This allows for mediators to gain a more targeted knowledge to help clients reach the agreements necessary to keep the matter from progressing to litigation if possible.

Some mediators are Court-appointed, and are affiliated directly with the justice system of the state. Others work on a freelance basis and are available for anyone to seek their services. The certification of mediators differs by state, so ensure that any mediator you select is properly certified for your needs.

While similarities exist between the duties and roles of moderators and mediators, each play their own role with little overlap. Moderators have very role specific positions, such as Internet forum moderators, while mediators often work with the judicial system, as a first step in an action, or to keep a dispute from proceeding to litigation entirely. Before selecting mediator vs moderator, be sure you know these differences and which role you require.

I can give you a history of the moderator on the forum. Once upon a time there were a couple of guys- we'll call them DutchBones and GermanHarpist were tasked with keeping peace on the forum. Then I came onboard and then they left and for a while Buzadero helped keep things calm. At the last official meeting (or was that just an email exchange) there were 4 of us, although one is inactive at this point and one is stuck where he can't access the site. That roster was Todd P., Todd G., Blocker and myself. Mostly it's just making sure BUYJERSEYSFROMBUYJERSEYS.COM doesn't get approved as a member and spam the place up, restoring comments the spam filter thought were spam and trying to help people access the site when the server is being a poopyhead (that's the technical support term). Occasionally it's moderating, trying to reframe the debate, and on very rare occasions it's acting like sheriffs. Moderator is probably a better word than mediator, but most of it really is paperwork.

And now, of course, we have to kill you since you know too much. Muhahahahahaha (cough) hahaha

Haha hi Frank, I have been called a girl and I am known to wear a mask from time to time (just for kicks). No evil twin here, my name is Pete and I live in Australia.

A while back Adam suggested the forum should have some international moderators and I volunteered really just as a thank you to Adam for this forum and all the free teaching stuff he has put online (which was a godsend to me when I first bought a harp). I do feel a bit bad for being a lurker and really should contribute more as I still read the forum most days, I do however approve members from time to time and also clear out the spam folder (no where near as much as Nate does though!!).

The forum was very different a few years back with tons of fighting words about all manner of seemingly meaningless stuff and I guess I was happy that Adam wanted to settle things down. Thankfully there's not a lot of need to actually step in to 'moderate' these days as that's not really my bag.
